Refund Policy
This Refund Policy applies to all Clients (“Client”) engaging Red Velvet Studios LA (“Studio”), its owners, contractors, employees, producers, creatives, and representatives, including but not limited to Producer Joseph S. Brooks (“Producer”), for any type of work, service, agreement, project, or contract.
This Policy is incorporated into all agreements, invoices, bookings, and transactions and is enforceable under California and U.S. contract law.
1. Non-Refundability of All Payments
Unless expressly required by California law, all payments made to the Studio and/or Producer Joseph S. Brooks are final and non-refundable. This includes:
- Deposits
- Partial payments
- Payment plans
- Session fees
- Service fees
- Producer fees
- Project payments
- Add-ons or supplemental payments
- Any advance or retainer
Payments are made in exchange for reserving time, expertise, labor, preparation, and resources — not for any guaranteed artistic or commercial result.
No refunds, credits, reimbursements, or chargebacks shall be issued after services have begun or after the 5-day cancellation window (Section 6).
This applies equally to:
- Red Velvet Studios LA
- Joseph S. Brooks personally
- Any producers, contractors, or creatives engaged through the Studio
2. Mutual Right to Cancel
Either party may cancel a project or agreement at any time.
2.1 Payments Remain Non-Refundable
All payments made prior to cancellation remain non-refundable, except where allowed under Section 6.
2.2 Outstanding Payments
Any remaining balances shall follow the terms in the Client’s signed contract. Contractual payment obligations are not voided by cancellation unless clearly stated.
2.3 No Obligation to Continue Work
Upon cancellation, neither the Studio nor Producer Joseph S. Brooks is obligated to complete, revise, or continue any work beyond what already exists as of the cancellation date.
3. Status of Work Completed to Date
Work completed before cancellation—regardless of its stage—is considered final and delivered “as-is.”
Neither the Studio nor the Producer is required to:
- Finish incomplete work
- Revise or enhance deliverables
- Provide additional assets
- Continue production
4. Liability Limitation & Producer Protection
To the fullest extent permitted by California law:
- The Client waives the right to seek refunds outside the terms of this Policy.
- The Studio and Producer Joseph S. Brooks are not liable for lost profits, emotional distress, creative differences, dissatisfaction, changes of mind, or indirect damages.
- Remedies available to the Client are strictly limited to what is written in this Policy and the corresponding contract.
This limitation of liability applies to:
- Red Velvet Studios LA
- Producer Joseph S. Brooks
- All contractors, employees, engineers, and creatives associated with the Studio
Nothing in this Policy waives rights that California law prohibits from being waived (e.g., fraud or intentional misconduct), but dissatisfaction with artistic results or creative direction does not constitute grounds for a refund or damages.
5. Definition of “Work Started” — Producer Protection Included
For refund considerations, work is considered “started” when any of the following occur:
- The Client attends a recording or production session
- Producer Joseph S. Brooks or any Studio personnel begin planning, creating, editing, recording, producing, mixing, or preparing
- Time is reserved or scheduling resources have been allocated
- Any form of creative, technical, or administrative work is initiated
Once work has started:
👉 All payments covering that work are non-refundable, regardless of the 5-day window.
👉 This applies equally to work performed by Red Velvet Studios LA and by Producer Joseph S. Brooks personally.
6. Five-Day Cancellation & Refund Request Window
The Client may request cancellation within five (5) calendar days from the date they:
- Sign a contract and/or
- Request work from the Studio and
- Make any form of payment (deposit, partial, or full)
6.1 Written Notice Required
Requests must be submitted in writing within the 5-day period.
6.2 Work Already Started
If work has started (Section 5), no refunds will be issued for that portion of the project, even if within the 5-day window.
6.3 After 5 Days
After the 5-day period:
- All sales are final
- All payments are fully non-refundable
- No refund requests will be accepted under any circumstances
This structure is enforceable under California contract law when agreed to in writing.
7. Agreement and Enforceability Under California Law
By making a payment, booking a session, requesting work, or signing any agreement, the Client acknowledges and agrees that:
- This Refund Policy is legally binding
- The terms protect both the Studio and Producer Joseph S. Brooks
- The Client accepts the refund limitations voluntarily
- This Policy supersedes any verbal statements regarding refunds
This Policy is intended to be fully enforceable under:
- California Civil Code
- California Business & Professions Code
- U.S. Contract Law principles
