Royalty Policy for Music Production
1. Master Royalties:
Joseph Brooks will receive a percentage of the master royalties for any song he produces, ranging from 25% to 50%. The exact percentage is to be determined based on the level of involvement and the specific agreement between Joseph Brooks and the artist prior to the production process.
2. Publishing Rights:
The ownership of publishing rights will be determined based on the amount of songwriting contribution by Joseph Brooks. For songs he has contributed songwriting to, he will receive a minimum of 25% of the publishing royalties.
• If Joseph Brooks is a co-writer or contributes to the lyrics, melody, or structure of the song, his share of publishing rights will reflect this contribution accordingly.
• The exact percentage will be agreed upon in writing between Joseph Brooks and the artist before the songwriting process begins.
3. Royalty Requirement:
Any project or production taken on at Red Velvet Studios must include a royalty percentage for Joseph Brooks. We do not accept 0% royalty agreements. A fair and agreed-upon royalty percentage for both master and publishing rights must be established as part of the deal. Without this, no agreement or collaboration will take place.
4. Agreement Details:
• All royalty percentages are negotiable and must be outlined clearly in a written agreement before any work begins.
• Royalties are to be paid on a quarterly basis or as otherwise agreed upon by both parties.
• Both master and publishing royalties are calculated based on the gross earnings from the song across all distribution channels, including but not limited to streaming platforms, radio airplay, and licensing deals.
5. Royalty Collection and Distribution:
Both Joseph Brooks and the artist agree to set up an appropriate system for the collection and distribution of royalties through a registered performance rights organization (PRO) or third-party administrator to ensure fair and timely payment.
This policy ensures that both parties are fairly compensated for their work and contributions in any music production or project at Red Velvet Studios.
